These terms are structured for OziCyber's current model: consulting, academy training and SaaS-style security solutions. They are practical website terms, not a substitute for formal legal advice.

Agreement

These Terms & Conditions govern your use of the OziCyber website, services and solutions. OziCyber Pty Ltd provides cyber security consulting, penetration testing, incident response, governance and compliance services, cyber security training, and security software solutions including OziCyber Training Academy, OziCyber Recon ASM and OziCyber MainFrame.

By accessing our website, requesting services, enrolling in training, using a platform, or otherwise engaging with OziCyber, you agree to these terms. Additional terms may apply through a proposal, statement of work, order form, subscription agreement, academy enrolment terms or master services agreement.

Cyber security services

Our consulting services may include penetration testing, AI security testing, web application testing, mobile application testing, infrastructure testing, OT testing, social engineering, incident response, cyber governance, ISO 27001, PCI-DSS and related security advisory work.

Testing and assessment services are performed only against systems, applications, assets, environments and people that are within the agreed scope and authorised by the client. You are responsible for ensuring you have all permissions required for OziCyber to perform the work, including permission from cloud providers, hosting providers, subsidiaries, suppliers and third-party system owners where relevant.

We may refuse, pause or terminate work if we reasonably believe the requested activity is unauthorised, unsafe, unlawful or outside the agreed scope.

Solution terms

Each solution has specific usage responsibilities and data handling expectations.

OziCyber Training Academy

Academy content, live classes, recordings, labs, exercises, templates, slides, notes and assessments are for personal learning and professional development. We do not guarantee employment, certification success, income, promotion or any specific career result.

OziCyber Recon ASM

Recon ASM is for authorised monitoring of assets you own, control or have permission to assess. Scan results may include false positives or incomplete findings and should be validated before operational or legal decisions are made.

OziCyber MainFrame

MainFrame is for cyber security reporting and workflow management. You are responsible for the information you upload, users you invite, access permissions you grant and lawful handling of confidential or regulated data.

Accounts, client data and confidentiality

If you are given access to an OziCyber platform, you must keep login details secure, use multi-factor authentication where available, maintain accurate account information, and promptly tell us if you suspect unauthorised access.

Client data remains owned by the client or its licensors. OziCyber uses client data to provide, secure, support and improve the relevant service, comply with law, and exercise our rights under applicable agreements. We restrict access to personnel, contractors and providers who need it for legitimate service delivery, support, security, legal or operational purposes.

Acceptable use

You must not use OziCyber services or solutions to:

  • Conduct unauthorised scanning, exploitation, phishing, social engineering, malware activity or surveillance.
  • Upload unlawful, harmful, infringing, misleading or malicious content.
  • Attempt to bypass platform limits, security controls, authentication or access restrictions.
  • Interfere with other users, third-party systems or OziCyber infrastructure.
  • Reverse engineer, copy, resell or commercially exploit our software, reports, templates or training materials except as expressly permitted.
  • Use outputs as a substitute for professional judgement, risk assessment or legal advice.

Intellectual property, fees and subscriptions

OziCyber owns or licenses the intellectual property in our website, branding, software, training content, methodologies, templates, report formats, documentation, tools and other materials we provide. Subject to payment and any agreed restrictions, clients may use final deliverables we prepare for their internal business, governance, audit, remediation and compliance purposes.

Where a service or solution is sold by subscription, the subscription tier, inclusions, limits, billing cycle, renewal terms and fees will be set out on the relevant pricing page, order form, invoice or agreement. Unless otherwise agreed, fees are exclusive of GST and other applicable taxes.

Security limitations

Cyber security work reduces risk but does not eliminate it. Penetration tests, scans, reports, training, advisory work and software outputs reflect the agreed scope, available information, timing, methods and constraints. We do not guarantee that every vulnerability, exposure, control weakness or threat will be found.

You are responsible for securing your own systems, endpoints, accounts, credentials, cloud environments, integrations and exported reports.

Liability, termination and governing law

To the maximum extent permitted by law, OziCyber is not liable for indirect, consequential, special, exemplary or punitive loss, loss of profit, loss of revenue, loss of goodwill, loss of opportunity, loss of data, business interruption, or claims arising from unauthorised use of services, out-of-scope activity, third-party systems, client instructions or client-supplied information.

We may suspend or terminate access to a service or solution if you materially breach these terms, fail to pay amounts when due, create security or legal risk, misuse a platform, request unauthorised activity, or where required to comply with law.

These terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth courts of Australia. For questions, contact info@ozicyber.com.au.
